These terms are an agreement between you and Palometa Group LLC, a Florida limited liability company that operates outboundangler.com (“Outbound Angler”, “we”, “us”). They apply to your use of the site. By using the site or creating an account, you agree to them. If you don’t agree, please don’t use the site. Our Privacy Policy explains how we handle personal information.
1. What Outbound Angler is
Outbound Angler is a directory of independent fishing guides and charter businesses. We don’t book trips, take payments, or provide guiding services. When you contact or hire a guide, the arrangement is between you and that guide. We aren’t a party to it.
Guides are independent businesses. They aren’t our employees or agents, and a listing doesn’t mean we endorse or vet them. Before you book, it’s your responsibility to confirm:
- the guide’s licenses, permits, insurance and vessel safety;
- current prices and availability;
- the fishing regulations that apply to your trip.
Some listings are premium or featured placements and may appear higher in results.
2. Accounts
- You must be at least 16 to create an account.
- Give accurate information and keep your email address current. We use it for verification, password resets and notices about your listings.
- You’re responsible for everything that happens under your account. Keep your password secret, and tell us if you think someone else has used your account.
- Each account is for one person. Don’t impersonate anyone, and don’t choose a username that is offensive or misleading.
- You can delete your account at any time from your profile page.
3. Listing a business
- Authority. Only submit, claim or manage a listing if you own the business or are authorized to act for it. We may check ownership, for example by comparing email and website domains or by emailing the business’s listed address. We may refuse or revoke access to a listing at any time.
- Accuracy. Keep your listing accurate and current, including prices, trips, contact details and whether you are operating. Don’t list services you don’t offer, and don’t submit the same business more than once.
- Our role in listings. We may publish a listing before the business claims it, using public information. We may also:
- review, edit, format, categorize, verify or add to any listing, including with automated tools and AI-assisted checks of the business’s public website;
- decline, suspend or remove a listing that appears inaccurate, is not a fishing guide or charter service, or breaks these terms.
- Closing a listing. Owners can close a listing from their dashboard. Closing is permanent from the owner’s side. To reopen a listing, contact us.
- Your content. You keep ownership of the text and photos you submit. You give us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, adapt (for example, resize or crop) and distribute them to run and promote Outbound Angler. The license continues for as long as the content is on the site, plus a reasonable time after it’s removed. You must have the rights to everything you upload, including photos of other people.
4. Reviews
- Only review a guide you have actually fished with, and base it on that experience. One review per guide per account.
- Don’t review your own business, a business you work for, or a competitor. Don’t offer or accept payment, discounts or other incentives for reviews.
- Keep reviews on topic. No threats, harassment, hate speech, personal information about others, or claims you know to be false.
- Reviews appear publicly with your username. You give us the same license described in section 3 for your review.
- We may hide or remove reviews that break these rules. We don’t remove reviews just because a guide dislikes them. Guides who think a review breaks these rules can contact us.
5. Acceptable use
Don’t:
- scrape, harvest or bulk-download listings or contact details, or use them to send spam or unsolicited marketing;
- use bots or automated scripts to create accounts, submit forms or post content, or try to get around our bot protection or rate limits;
- probe, scan or test the site’s security, or interfere with its operation;
- access areas or accounts you aren’t authorized to use;
- post unlawful, infringing, deceptive or malicious content, including malware;
- use the site in any way that breaks the law or harms others.
Search engines that follow our robots.txt are welcome.
6. Content & ownership
Everything on the site other than user-submitted content belongs to Outbound Angler or its licensors. That includes the site design, logo, text, our editorial and journal content, and the way the directory is compiled and organized. You may view and share pages for personal, non-commercial use. Don’t copy or republish substantial parts of the directory without our written permission.
If you believe content on the site infringes your copyright, email us. Tell us what the work is, where it appears on the site, and how to reach you.
7. Third-party sites
Listings link to guides’ own websites, social media and other third-party sites. We don’t control those sites and aren’t responsible for their content or practices.
8. Disclaimers
The site and all listings, reviews and other content are provided “as is” and “as available”. Much of the content comes from guides, users and public sources, and we can’t guarantee it is accurate, complete or current. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
Fishing and boating carry real risks. You are responsible for your own safety and for deciding whether a guide or trip is right for you.
9. Limitation of liability
To the fullest extent the law allows, Palometa Group LLC and its members, managers and agents are not liable for any indirect, incidental, special, consequential or punitive damages. We are also not liable for any loss of profits, data or goodwill arising from your use of the site. That includes anything to do with a guide you found here or a trip you took. Our total liability for any claim relating to the site is limited to US $100.
Some places don’t allow these limits, so they may not all apply to you. Nothing in these terms limits liability that can’t legally be limited.
10. Indemnity
You agree to indemnify and hold harmless Palometa Group LLC and its members, managers and agents from claims, losses and costs (including reasonable legal fees) arising from:
- content you submit;
- your use of the site;
- your breach of these terms;
- for guides, the services your business provides.
11. Suspension & termination
We may suspend or close accounts, or remove listings or content, that break these terms or put users or the site at risk. We may also change or discontinue any part of the site. You can stop using the site and delete your account at any time. The sections on content licenses, disclaimers, limitation of liability and indemnity continue to apply afterwards.
12. Changes
We may update these terms, and we’ll change the effective date at the top when we do. If a change is significant, we’ll give notice on the site or by email before it takes effect. If you keep using the site after that, you accept the new terms.
13. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these terms or your use of the site will be decided only in the state or federal courts located in Texas, and you and we consent to their jurisdiction. This doesn’t take away any protection you have under the mandatory consumer laws of the place where you live.
